【摘要】We propose a structural bargaining model where players hold heterogeneous beliefs about the nal resolution if no settlement is reached outside the court. We show the distribution of their beliefs and the stochastic surplus are nonparametrically identi ed from the probability for reaching an settlement and the distribution of nal transfers between players. We then use a Simulated Maximum Likelihood (SML) approach to estimate the beliefs of doctors and patients in medical malpractice lawsuits in Florida in the 1980s and 1990s. We nd strong evidence that the beliefs for both parties vary with the severity of the injury and the quali cation of the doctors in the lawsuits, even though these characteristics are statistically insigni cant in explaining whether the court rules in favor of the plainti¤ or the defendant.
